Exclusion du calcul du rapport d’assujettissement à la taxe sur les salaires

Pour l’application de l’article 231, 1 du CGI, les abandons de créance ne constituent pas des recettes ou autres produits devant être inclus dans les chiffres d’affaires retenus pour l’assujettissement à la taxe sur les salaires.

En se fondant, pour rejeter la demande de décharge des rappels de taxe sur les salaires, sur la circonstance que les abandons de créance en litige constituaient des recettes au sens de l’article précité, la cour administrative d’appel de Paris a commis une erreur de droit.

Publication de la loi visant à prévenir les ingérences étrangères

La loi n° 2024-850 du 25 juillet 2024 vise à renforcer la prévention des ingérences étrangères en France. Elle instaure un registre public des activités d’influence étrangère, géré par la Haute Autorité pour la transparence de la vie publique (HATVP), où toute personne ou entité agissant pour un mandant étranger devra déclarer ses actions visant à influencer la décision publique.

Certaines actions, comme les contacts avec les pouvoirs publics ou le financement, doivent être déclarées, à l’exception des diplomates et agents consulaires. Le non-respect de cette obligation est puni de trois ans de prison et d’amendes, avec des peines plus lourdes pour les personnes morales.

La loi introduit aussi l’utilisation d’algorithmes pour lutter contre les ingérences étrangères, un mécanisme de gel des fonds, et une aggravation des peines pour les crimes commis au service d’intérêts étrangers. Un rapport sur les menaces pour la sécurité nationale devra être remis au Parlement tous les deux ans.
